A Member Has the Right to Insist Upon Protective Equipment - The Occupational Safety
Health Administration states that employers are obligated to provide their workers with the
conditions needed to keep them safe while performing their jobs. An employee may have the right to insist upon personal protective equipment if their work presents the possibility of exposing them to the coronavirus (ex. gloves, goggles, face shields, face masks, and respiratory protection, when appropriate). An employee is within his rights to insist upon the appropriate amount of PPE based on the risk of exposure. If an employee believes that the measures being taken to protect his or her safety are not adequate, he or she should contact a Union Business Manager. There are remedies under the Occupational Safety and Health Act (OSHA), the National Labor Relations Act (NLRA), and the CBA.
